The introduction of sectoral targets and compliance certificates can have radical implications for employers who are not compliant.
On 14 April 2023, our President signed the Employment Equity Amendment Act (Act 4 of 2022) into Law. This Act amends the current Employment Equity Act (Act 55 of 1998), although the effective date of the amendments is yet to be proclaimed.
One of the planned amendments include the introduction of sectoral targets, which will empower the Minister of Employment and Labour to set targets for the different economic sectors of business. The aim of these targets will be to accelerate equitable representation of designated groups (previously disadvantaged groups as defined by this Act, based on race, gender and disability) per occupational level.
On 1 February 2024, draft Regulations that focused specifically on the proposed sectoral targets were circulated for public comment within a 90-day period. This period has now lapsed and we anticipate an implementation date to be announced shortly.
